Be aware – Whistler has many “Restricted Use” properties

Buyer beware! Some of Whistler’s buildings are very restrictive, as far as Owner usage is concerned. While this might not be an issue for some, particularly someone who may have bought purely for investment purposes and will be using the property infrequently, for others the restrictions make a purchase undesirable.

The purpose of “Phase Two Zoning”, as it is locally known, is to ensure there is always a large pool of properties available to Whistler visitors. Under this ”zoning”, the owner is allowed to do the following:

  • Have personal use of the property for up to 28 days in the summer season (April 15 to Oct 15) and up to 28 days in the winter season (Oct 15 to April 15).
  • A maximum of 21 consecutive days can be booked in each season.
  • Short term bookings can usually be made if the occupancy rate of the hotel is less than 80%.

As these properties must be made available for nightly rental, they are considered commercial ventures and are therefore taxed at the commercial rate. Additionally, the owners of these ”Phase Two” properties are obliged to sign a hotel rental management agreement.
